Florida Nudity Laws
Here's the statute for Lewdness/Indecent Exposure in Florida:
800.03Exposure of sexual organs.
(1)A person commits unlawful exposure of sexual organs by:
(a)Exposing or exhibiting his or her sexual organs in public or on the private premises of another, or so near thereto as to be seen from such private premises, in a vulgar or indecent manner; or
(b)Being naked in public in a vulgar or indecent manner.
(2)(a)Except as provided in paragraph (b), a violation of this section is a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.
(b)A second or subsequent violation of this section is a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(3)The exposure of sexual organs by any of the following does not violate this section:
(a)A mother breastfeeding her baby; or
(b)An individual who is merely naked at any place provided or set apart for that purpose.
_____
Based on section (1)(a) you have to be displaying yourself in a public place or on someone else's private property to run afoul of the law. If you are on your own private property, the statute would not apply. If you're invited onto or have the owner's permission you fall under the exception described in (3)(b).
The law in Florida is very clear. Years ago the Florida Supreme Court ruled that "nude is not lewd," so as long as you're not performing a lewd act, like jacking off, you can be nude. BUT there are many local "ins and outs" about "exposure of sexual organs" and "intent" has a lot to do with it. So, for example, if you answer the door nude you're okay. BUT if two Girl Scouts come to the door selling cookies, and you ask them to wait there while you go get your wallet, and you come back (again) nude, you may wind up in jail because a court will say, in effect, "You're not being a nudist, you just wanted to show off your package to some kids!" So, intent is taken into account!
Ftom what Ive seen online the Florida courts view being nude in your car as being in your personal property or space thats my phrasing. But again not being lewd then no problem. I have driven at length naked w no problem. Rockledge to ft pierce blind creek beach and back . Too playalinda and back and to home from tampa cruise port. All naked. Maybe I was lucky , but I think, people dont care and law enforcement certainly doesn't.
Good to know, thank you. I have been in the Seattle area now for 30 years, my plan is to retire in 5 and when I do, I plan on moving to Florida. Currently looking to be the greater Ft Lauderdale area, but am always open. The wife and I generally look to make it to Florida a couple times a year.
Yes, Florida laws concerning nudity are complicated but still liberal by US standards despite being a relatively conservative state otherwise. California is another state with areas with a climate conducive to nudity, but less tolerant laws
Vermont and Oregon are two very liberal states with the most liberal laws concerning nudity, but not very good climate for it.
