Has anyone been warned to cover up or be arrested?
Return to DiscussionsIn my state it could be a simple misdemeanor or a class 6 felony if children under 14 are present.
I did get a piece of advice from a cop when you are driving nude...always have a towel in the car in case you are stopped...if you are cover with the towel you cannot be arrested for indecent exposure.
When hiking in a big nude group in the Austrian Alpsa woman reported us to the police. They intercepted us a bit later. After some lengthy discussion the police agreed that we were OK hiking naked in the wilderness but needed to cover up when going through any villages. We did that anyhow.
A week earlier I'd been walking naked around my village. It was about 5am and I figured everyone would be in bed. A colleague drove by and caught me. A day or two later he pulled me to one side for a serious telling off. I have noticed that the men I come into contact with are more likely to be anti-nudist than the women.
I once received a citation when in my early 30's, along with about half a dozen others who were sunbathing naked in a city park. Had to go to court, judge dismissed charges completely, since that particular location was a place where it was pretty well an established nude area even though, technically, it was illegal.
I live in Alabama. Recently I was reported by someone when I was on a jogging train around 1:30 AM I passed somebody while walking and said "Hi" but he reported me and they got a second report. Cops pulled me over had me get out of the car, but I had my shorts on said charges weren't being pressed. Tried to make me angry then let me go. That just about closes off anywhere I can walk nude where I live.
All that I have read and all that I have heard, along with being nude myself/ourselves, in National Parks ... there are no laws against simple nudity within the National Parks. A letter was recentlyreceived bya local lawyer, also a nudist and member of TheNaturist Society and nude beach group,from the Los Angeles County Sheriff's Dept. In the letter, it states that simple nudity in the National Forests is not prohibited by law. The Sheriff mentioned that his deputies would be briefed on the Penal Code and that there is currently no law against simply being nude in the National Forest.
I ran into a female Park Ranger in Death Valley. Our group of firemen asked her lots of questions and when they were done, I walked with her back to her truck and asked her if it was against the law to simply be nude in the National Park. To my surprise, she said, "no it is not against the law and I see nude hikers up here all the time." I thanked her, shook her hand and she said, "just be safe!" (wink)
Most times a Ranger or officer won't know the law and act on personal feelings or philosophies on a number of things. I think it's imperative that we know the laws so that when we are confronted, we can speak legally and correctly about what we might be charged with. BUT ... from all I've read, there are no laws against simply being nude in the National Parks.

From what I've read, this can be a tricky situation. Except for the Cape Cod National Seashore, there are no federal laws prohibiting nudity in the National Park System (as far as I know, and I'm not a lawyer). However, if you're violating a state or local law, the park rangers can arrest you and turn you over to the local cops. It's sort of a concurrent jurisdiction deal. So, even if you're on federal land, you can be arrested for violating a local nudity ordinance. Try to find out how the rangers deal with things before getting too comfortable!
