I rarely wear a shirt when driving in warm weather and have never been stopped to see I was wearing shorts (I was). Have been stopped at least twice for traffic violations and no mention was made of my lack of a shirt.
Driving shirtless in my part of the country is rather rare now except on very hot days. As you say, most people assume you're dressed if you're wearing a tank top or t shirt. When I used to go out naked driving at night with a friend, we would usually wear only short sleeved button-up shirts with the buttons left open, and we never got noticed. Even one time when someone in a tiny crossroads town waved us down from his car to ask directions, he didn't know he was talking with two mostly naked men. That was fun.
